Terms and Conditions

nkoffers.in (hereinafter "nkoffers", "we", "us", or "our") is an affiliate marketing, cashback, rewards, and paid campaigns platform. By registering, accessing, or using our platform, you agree to be bound by these Terms and Conditions. Please read them carefully before proceeding.

1. Definitions

• "Affiliate" – A user who promotes offers, generates clicks/conversions, and earns commissions.
• "Cashback" – A percentage of the purchase value returned to the user after a qualifying transaction, subject to advertiser approval and validation.
• "Campaign" – A paid or incentivized promotion offered by an advertiser through our platform.
• "Commission" – The earnings an Affiliate receives for a successful conversion, subject to advertiser validation.
• "Conversion" – A qualifying action (sale, sign-up, install, etc.) completed by a referred user.
• "Dashboard" – The private area where users view earnings, stats, and manage their account.
• "Advertiser" – A brand or business running campaigns on nkoffers.

2. Eligibility & Account Registration

To use our platform as an Affiliate or Cashback user, you must:

• Be at least 18 years of age.
• Provide accurate, complete, and up-to-date information during registration.
• Maintain the confidentiality of your login credentials.
• Notify us immediately of any unauthorized use of your account.
• Have a valid payment method (UPI, bank account, PayPal) for receiving payouts.

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.

3. Affiliate Program & Commission Structure

3.1 Commission Rates

Commission rates are campaign-specific and displayed on your dashboard. Rates may vary based on the offer, advertiser, and performance tier.

3.2 Qualified Conversions

A conversion is considered qualified when:

• The referred user completes the required action (purchase, sign-up, etc.) through your unique affiliate link.
• The conversion is verifiable and not reversed due to fraud, return, or cancellation.
• It occurs within the campaign's valid tracking window (cookie duration).
• The conversion is validated and approved by the advertiser.

3.3 Payouts

• Payouts are processed weekly on Fridays, subject to a minimum payout threshold (if any).
• Payments are made via the method selected in your dashboard (UPI, bank transfer, PayPal).
• nkoffers reserves the right to hold payments for investigation if suspicious activity is detected.
• Commissions are only payable after the advertiser confirms and approves the conversion.

4. Cashback & Rewards

• Cashback is credited to your account only after the transaction is confirmed and approved by the advertiser. This typically takes 7–30 days, depending on the advertiser's confirmation cycle.
• Cashback may be reversed if the original transaction is refunded, charged back, found to be ineligible, or if the advertiser rejects the validation.
• Reward points are non-transferable and have no cash value unless explicitly stated.
• We reserve the right to modify, suspend, or discontinue any cashback or reward program at any time.
• All cashback and rewards are subject to advertiser approval and final validation. nkoffers acts as an intermediary and does not guarantee approval.

5. Paid Campaigns

• Advertisers may launch paid campaigns with specific terms, budgets, and payout structures.
• Affiliates participating in paid campaigns must adhere to the campaign-specific guidelines.
• Payouts for paid campaigns are subject to advertiser verification and approval. nkoffers may hold payments until the advertiser confirms the conversions.
• nkoffers acts as an intermediary and is not responsible for advertiser payment defaults, though we make reasonable efforts to collect and disburse funds.
• All campaign earnings are subject to advertiser validation and may be reversed if the advertiser rejects the conversion.

6. Prohibited Activities

You agree not to engage in any of the following:

• Fraudulent activity: Fake clicks, bot traffic, self-referrals, or any method that artificially inflates conversions.
• Misleading promotion: Using deceptive or false advertising to generate clicks or conversions.
• Spam: Unsolicited bulk emails, SMS, or any form of spam to promote affiliate links.
• Adware/Malware: Using intrusive software to redirect traffic or install unwanted programs.
• Brand bidding: Bidding on advertiser-branded keywords without explicit permission.
• Violation of laws: Any activity that violates applicable laws, regulations, or third-party rights.

Violation of these prohibitions may result in immediate account termination and forfeiture of commissions.

7. Intellectual Property

• All content on nkoffers.in, including text, graphics, logos, and software, is our property or licensed to us.
• You may not reproduce, distribute, or create derivative works without our prior written consent.
• Affiliates are granted a limited, non-exclusive license to use our creatives and materials for promotional purposes only.

8. Data Privacy & Cookies

We collect and process personal data in accordance with our Privacy Policy. By using our platform, you consent to such processing. We use cookies for tracking and analytics as described in our Cookies Policy.

9. Disclaimer of Warranties

• nkoffers provides the platform "as is" and "as available" without any warranties, express or implied.
• We do not guarantee that the platform will be error-free, secure, or uninterrupted.
• We are not liable for any loss or damage arising from your use of the platform or reliance on any information provided.

10. Limitation of Liability

• To the maximum extent permitted by law, nkoffers shall not be liable for any indirect, incidental, special, or consequential damages.
• Our total liability to you for any claim arising out of or relating to these Terms shall not exceed the total commissions paid to you in the 12 months preceding the claim.
• We are not responsible for the actions or omissions of advertisers or third-party payment processors.

11. Indemnification

You agree to indemnify and hold nkoffers, its officers, employees, and affiliates harmless from any claims, damages, losses, or expenses arising from your violation of these Terms, your use of the platform, or your infringement of any third-party rights.

12. Termination

• You may terminate your account at any time by contacting us.
• We reserve the right to suspend or terminate your account for breach of these Terms, fraud, or any activity that harms our platform or users.
• Upon termination, any pending commissions may be forfeited if they are not yet confirmed or approved by the advertiser.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes via email or a prominent notice on our platform. Your continued use of nkoffers.in after the effective date constitutes acceptance of the updated Terms.

14. Governing Law & Dispute Resolution

• These Terms are governed by the laws of India.
• Any disputes arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts in Mumbai, India.
• We encourage you to contact us first to resolve any issues amicably.
